Email and Text Communication Terms and Conditions

1. Introduction:
Please carefully review the following Email and Text Communication Terms and Conditions. By checking the box to sign up for one or more text messaging programs, you expressly consent to receive non-marketing and marketing emails and text messages from each of Bath Fitter Distributing Inc. (“BF Distributing”) and its affiliates (which shall include any entity that directly or indirectly (including through one or more intermediaries), controls, is controlled by, or is under common control with BF Distributing, each a “BF Affiliate”, and collectively the “BF Affiliates”), and Bath Fitter® franchisees, who either post these Email and Text Communication Terms and Conditions on their websites, or use https://www.bathfitter.com as their website (the “Franchisees”, and collectively with BF Distributing and the BF Affiliates, and/or individually, “BF Group” “our”, “us” or “we”), or others emailing or texting on BF Group behalf, at the email and mobile telephone number(s) that you provide.
2. Program description:
When opted-in, you will receive email and text messages (SMS/MMS) to your email address and mobile number. These kinds of messages may include, but are not limited to: a quote estimate, response to a service or product inquiry, real-time texts to ask and answer questions about our services and pricing, appointment scheduling and confirmations, feedback requests, project updates, follow up, or answer to any question that you may have (collectively, the “Program”).
3. Program frequency:
You can expect to receive as many emails or messages per month from us, as necessary to fulfil the goal of such communication.
4. Opt out:
You may opt-out of text communications at any time by replying STOP, QUIT, CANCEL, OPT-OUT, or UNSUBSCRIBE to any text message sent from us. After this, you will no longer receive text messages from us. If you wish to unsubscribe from our email campaigns, please click on the Unsubscribe link at the bottom of any marketing email sent from us. If you opt out of our email marketing, we will still send you messages related to our transactions and relationship with you, such as order confirmations. If you want to join again, just sign up as you did the first time and we will start sending text messages or emails to you again. Consent to receive marketing emails or text messages is not required to purchase any goods or services.
5. Eligibility:
To receive BF Group emails or texts, you must be 18 years of age or older. BF Group reserves the right to require you to prove that you are at least 18 years of age.
6. Your Email and Mobile Telephone Number:
You represent that you are the owner of the email address and the account holder for the mobile telephone number(s) that you provide. You are responsible for notifying us immediately if you change your email or mobile telephone number. You agree to indemnify BF Group in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify BF Group if you change your email or mobile telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
7. Disclaimer and Interruption:
The Program is offered on an “as is” basis. BF Group will not be liable for any delays or failures in the receipt of any email or text messages connected with the Program. Delivery of email or text message is subject to effective transmission from your carrier, wireless service provider, or network operator, and is outside of BF Group’s control. Your wireless service provider, or network operator is not liable for delayed or undelivered emails or text messages. Your participation in the Program is at your sole discretion and risk, and if you are dissatisfied with the Program, email or text message content, or these Email and Text Communication Terms and Conditions, you should opt-out (as described in Section 4 hereof) and cease use of the Program.

9. Cost:
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
10. Email and Text Communication Terms and Conditions Acceptance:
You also accept and agree to be bound by these Email and Text Communication Terms and Conditions, our Privacy Policy (available at: https://www.bathfitter.com/ca-en/privacy-policy/), and any other applicable terms and agreements related to your use of BF Group’s services.

12. Changes to Email and Text Communication Terms and Conditions:
BF Group may revise, modify, or amend these Email and Text Communication Terms and Conditions at any time. Any such revision, modification, or amendment shall take effect when it is posted to https://www.bathfitter.com/ca-en/terms-and-conditions/. You agree to review these Email and Text Communication Terms and Conditions periodically to ensure that you are aware of any changes. Your continued consent to receive BF Group emails and texts will indicate your acceptance of those changes.
